1. Acceptance of terms
By placing an order for a product on Volvo Merchandise Web Shop, you are offering to purchase the product subject to the following terms and conditions. Specifically, n agreement containing these general terms and conditions is formed between you as the purchaser (Purchaser) and Volvo Group Merchandise Services (VGMS) when the Purchaser’s order is placed on the Volvo Merchandise Web Shop and is confirmed by VGMS via e-mail or equivalent written message. A purchaser must be 18 years old t to purchase a product from the Volvo Merchandise Web Shop. By registering on www.volvobrandshop.com you and/or the entity Purchaser consents to receive promotional emails from VGMS for merchandise products and special events throughout the calendar year.
2. Delivery time
The delivery time for ordered products in stock is normally one week after VGMS’ order confirmation unless otherwise stated in VGMS’ order confirmation.
3. Delivery and freight
All deliveries within North America will be shipped via FedEx or alternate comparable carrier at VGMS’ sole discretion at the time of order fulfillment. VGMS may, in its sole discretion, honor Purchaser’s request for shipment via an alternative carrier. The goods shall be considered delivered when the goods are delivered to a carrier for shipment to a location specified by Purchaser.
4. Freight costs and other additional costs
Freight costs are listed in the Web Shop and are always in addition to the purchase price. Purchaser is solely responsible for customs duties, local taxes, and other charges. VGMS retains sole discretion to decline orders from or shipment to countries outside the United States and Canada.
All apparel items are sold in US sizes. Please reference the VGMS size chart link that can be found on each apparel product page.
All prices listed on the Web Shop are specified in USD excluding United States Federal and or Local taxes where applicable. Note that B2B transactions may be tax exempt and may require Purchaser to supply Fed Tax ID for processing. Deliveries outside United States may be exempt from some taxes as prescribed by Federal law. VGMS reserves the right to alter prices displayed on the Web Shop at any time without prior notice.
7. Payment (Purchaser)
Consumers: Payment for products ordered by consumers shall be made by means of a [VISA, MasterCard or American Express] credit card. Upon VGMS’ receipt of the Consumer’s order, Consumer authorizes VGMS to make a preauthorization check of Consumer’s credit card to ensure sufficient funds to cover the purchase. Consumer’s credit card will be charged at the point of sale.
Dealers: VGMS may bill products ordered by a dealership transaction to a Purchase Order (P.O.) or a credit card depending on the total value of merchandise ordered. (Note that orders less than $250.00 must be paid by credit card). Payments for orders billed to a P.O. shall be made no later than thirty (30) days after VGMS issues an invoice of the total purchase price. Delayed payments will be subject to penalty interest charge of 10% of the total value of the order in question.
Authorized Volvo Group Truck Dealers: VGMS will invoice orders placed by Volvo Dealers to the Volvo Dealer’s Parts Account.
Corporate sales within Volvo Group: Volvo Business Areas (BAs) may have the opportunity to purchase merchandise via the internal system (EBD) or via credit card.
8. Notice of claims of defect
Purchaser shall within three (3) business days after receipt of goods submit in writing to VGMS any defects which are discovered. Should Purchaser fail or omit to submit a claim in accordance with the above, Purchaser forfeits any right to submit a claim for any defect.
9. Return policy
Immediately upon receipt of the Product, the Purchaser shall check that the Product is complete and has not suffered any damage or is defective. If the outer packaging is damaged, you must report any goods damaged during shipment to the Shipper (in most cases FedEx) and e-mail a copy of the claim to VGMS at firstname.lastname@example.org. You must report external damage immediately upon receipt, and in no event more than twenty-four (24) hours after delivery to you. You must report concealed damage within three (3) business days after delivery to you. VGMS will not accept the return of damaged merchandise, which has not been timely, reported.
If the Merchandise is defective or deviates from the specifications provided on the Volvo Merchandise Web Shop, VGMS will replace it in a timely manner free of shipping charge. In the event of a defective Product, always contact VGMS Customer Support at email@example.com, and we will guide you through the process and supply you with a return authorization number.
You may return unused items within 15 business days of delivery for a refund, less a 15% restocking fee. Returned articles must be packed with care in the original packaging to prevent damage. Returned articles damaged during return to VGMS and articles not repackaged in original packaging may be assessed additional fees or not accepted.
If the return is a result of a shipping error, VGMS will pay the return shipping costs.
Please note that returns and exchanges will not be accepted after 15 business days of delivery.

10. Force majeure
VGMS is not responsible for delay or failure to perform resulting from acts beyond its control. Such acts include, but are not limited to, labor conflict fire, war, mobilization, unforeseen military action or the equivalent extent, requisition, confiscation, currency restrictions, riots and disturbance, or shortage by or delays in deliveries from sub-suppliers or manufacturers. In such circumstances, VGMS shall not be obligated to perform.
11. Personal data
VGMS will store and process the Purchaser’s personal data to fulfill its obligations towards the Purchaser in accordance with these General Terms. The Purchaser’s personal data may also be processed in connection with direct marketing by VGMS and its partners or for statistical reasons, which may involve coordination with other records. Purchaser has the right, at any given time, to request that VGMS not use the personal and or legal entity data in connection with direct marketing by requesting that they be removed from email subscription list. Fulfillment of such request may take up to four to six weeks.
VGMS is not liable for errors in printing, information and goods specification, or any possible pricing errors. Illustrations shall only be regarded as images and do not depict the actual goods in detail.
The complete content of VGMS’s website is the legal property of VGMS or its suppliers. As such, the content is protected by copyright, marketing and trade mark laws. Brand names, company names, product names, information about goods including goods description, weight, illustration, images, graphics, design, layout and other content of these pages may not under any circumstances be downloaded, copied or used without VGMS’ prior written authorization .
14. Disputes and governing law
Any dispute, controversy, or claim arising out of, or in connection with, this agreement, or the breach, termination or invalidity thereof, shall be exclusively settled by a court of competent jurisdiction for Guilford, North Carolina. . Governing law shall be the substantive laws of North Carolina
